Geographical indication (“G.I”) is a designation that indicates the unique and original qualities of product originating from particular geographical location. The human factor (Indigenous people) plays big role in creation indication, addition to environmental factors. Preserving intellectual property rights Indigenous People through G.I will result more advantageous impact on their community, especially for those who rely products livelihood. This not only safeguards cultural identity dignity but also enables them benefit commercial value property, whether direct sales or licensing agreement. Indonesia have ratified International regulation issued Law No. 20 2016 concerning Trademark Indications. purpose this research evaluate examine current status protection assess if it being implemented line with expectations set forth relevant legislation based supportive data previous cases. paper then illustrate advantages communities preserving registering indications, using examples successful registrations around world. type method normative while approaches employed are statutory conceptual an analytical descriptive design.
